{"id":5121,"date":"2018-09-20T12:41:39","date_gmt":"2018-09-20T11:41:39","guid":{"rendered":"https:\/\/woodpecker.co\/blog\/?p=5121"},"modified":"2025-03-24T16:31:53","modified_gmt":"2025-03-24T15:31:53","slug":"email-law","status":"publish","type":"post","link":"https:\/\/woodpecker.co\/blog\/email-law\/","title":{"rendered":"Quick Legal Guide to Email Outreach: 6 Rules to Follow"},"content":{"rendered":"<p>As with any form of business communication, there are a couple of rules you need to follow to make your <span id=\"urn:enhancement-f7839a9e\" class=\"textannotation disambiguated wl-thing\">email<\/span> outreach professional.\u00a0I took some time to\u00a0research the requirements for a proper <span id=\"urn:enhancement-a13380\" class=\"textannotation disambiguated wl-thing\">email<\/span> outreach in countries, such as Canada, China, Australia, New Zealand, not to mention the United States (with recently updated <a href=\"https:\/\/woodpecker.co\/blog\/news\/california-privacy-act\/\" target=\"_blank\" rel=\"noopener noreferrer\">California law<\/a>), Norway, Germany, Switzerland, and of course, the rest of the countries that are a part of the European Union (read about <a href=\"https:\/\/woodpecker.co\/blog\/cold-email\/general-data-protection-regulation\/\" target=\"_blank\" rel=\"noopener noreferrer\">GDPR<\/a> here).<\/p>\n<p>That may seem like a lot to handle in one article, but\u00a0I distilled down all I&#8217;ve found into a basic set of requirements for you to keep in mind next time you write a cold <span id=\"urn:enhancement-11049e95\" class=\"textannotation disambiguated wl-thing\">email<\/span>.<\/p>\n<h2>Why we need to\u00a0think about it?<\/h2>\n<p>Looking at ways countries regulate <span id=\"urn:enhancement-ff132484\" class=\"textannotation disambiguated wl-thing\">email<\/span> sending, there&#8217;s a strong tendency to\u00a0protect the personal information of their citizens. We use cold <span id=\"urn:enhancement-4b47606b\" class=\"textannotation disambiguated wl-thing\">email<\/span> to contact companies we haven&#8217;t contacted before. We don&#8217;t know them in person. We haven&#8217;t interacted with them before. We just assume they would be a good customer, based on some assumptions we&#8217;ve made on <a href=\"https:\/\/woodpecker.co\/blog\/prospecting\/ideal-customer\/\" target=\"_blank\" rel=\"noopener noreferrer\">who our ICP is<\/a>. We don&#8217;t have any\u00a0bad intentions. We just want to talk\u00a0to them.<\/p>\n<p>Now, let&#8217;s switch perspective. I&#8217;m sure you&#8217;ve gotten a few cold <span id=\"urn:enhancement-280f6a21\" class=\"textannotation disambiguated wl-thing\">emails<\/span> in your\u00a0career. And\u00a0one of them might have seemed ill-targeted for you. You weren&#8217;t quite sure why\u00a0you got it. You didn&#8217;t feel much like responding. So you just left the sender hanging.<\/p>\n<p>What if I told you that by respecting the\u00a0basic requirements\u00a0of sending cold <span id=\"urn:enhancement-4e05e06f\" class=\"textannotation disambiguated wl-thing\">emails<\/span>, you could actually\u00a0have a winning cold <span id=\"urn:enhancement-160334f\" class=\"textannotation disambiguated wl-thing\">email<\/span> strategy?<\/p>\n<p>Here is what\u00a0you should pay attention to in order to design such a strategy.<\/p>\n<h2>Basic requirements for sending a cold email campaign<\/h2>\n<p>There are\u00a06 basic requirements I discovered by\u00a0looking at\u00a0policies around the world.<\/p>\n<h3>Rule #1:\u00a0Give a way out from your emails<\/h3>\n<p>According to the CAN-SPAM Act that is binding in the USA, you&#8217;re not obliged to collect consent, but you should give an option to opt out from\u00a0getting your <span id=\"urn:enhancement-f1dc2f70\" class=\"textannotation disambiguated wl-thing\">emails<\/span>. The same goes for GDPR. When you send a <a href=\"https:\/\/woodpecker.co\/blog\/how-to-write-a-cold-email-that-actually-works-six-step-tutorial\/\">cold <span id=\"urn:enhancement-5c11cd20\" class=\"textannotation disambiguated wl-thing\">email<\/span><\/a> to the EU member state, you need to give a clear way to opt out. In Canada, Germany, Norway, Switzerland,\u00a0and Australia, an unsubscribe should also be included in your message.<\/p>\n<h4>What does it mean?<\/h4>\n<p>When writing an <span id=\"urn:enhancement-ea00b698\" class=\"textannotation disambiguated wl-thing\">email<\/span> copy, let the message receivers know how they can unsubscribe from your <span id=\"urn:enhancement-5053feac\" class=\"textannotation disambiguated wl-thing\">email<\/span> sequence. That should be a no-brainer even without the legislation that stands behind it. Your prospects should identify you &#8212; at least, that&#8217;s how the China lawmakers see it. You need to let your prospect know who you are\u00a0when you send <span id=\"urn:enhancement-a864939e\" class=\"textannotation disambiguated wl-thing\">email<\/span> to Switzerland, Norway,\u00a0New Zealand, Australia, Canada,\u00a0and the USA, too. Basically, it&#8217;s a given in the most regulations I&#8217;ve seen.<\/p>\n<h4>How to go about it?<\/h4>\n<p>In <a href=\"https:\/\/woodpecker.co\/blog\/cold-email\/how-to-write-a-cold-email-that-actually-works-six-step-tutorial\/\" target=\"_blank\" rel=\"noopener noreferrer\">6 steps to perfecting cold email copy<\/a>, you&#8217;ve read that your signature is an essential cold email part that tells your addressee who you are. Use it to comply with the law.<\/p>\n<p>Put all\u00a0the necessary pieces of information there\u00a0that help a prospect to identify you. So your name, company name, and much more are the bits of info you should consider adding. Read our guide to a signature to learn how to do it.<\/p>\n<p><a href=\"https:\/\/woodpecker.co\/blog\/cold-email\/a-little-big-thing-what-do-i-put-in-my-email-signature\/\" target=\"_blank\" rel=\"noopener noreferrer\">What Should I Put In My Signature? &gt;&gt;<\/a><\/p>\n<p>Some legislations define even more technical aspects of <span id=\"urn:enhancement-dc8b2ff8\" class=\"textannotation disambiguated wl-thing\">email<\/span> sending when it comes to the sender identification.\u00a0The headers of the commercial <span id=\"urn:enhancement-b5571001\" class=\"textannotation disambiguated wl-thing\">email<\/span>, which indicate the source, destination, and routing information, must not contain materially false or materially misleading information.<\/p>\n<h3>Rule #3: Contact Credentials<\/h3>\n<p>You might be\u00a0obliged to put a physical address of your company in the cold <span id=\"urn:enhancement-7ebec8e8\" class=\"textannotation disambiguated wl-thing\">email<\/span>. Here&#8217;s\u00a0a list of countries that require you to include the physical address:<\/p>\n<ul>\n<li>Canada<\/li>\n<li>Germany<\/li>\n<li>Norway<\/li>\n<li>Switzerland<\/li>\n<li>Australia<\/li>\n<li>New Zealand<\/li>\n<li>all EU member states<\/li>\n<\/ul>\n<h3>Rule #4: You need\u00a0to\u00a0have a valid reason for contacting people<\/h3>\n<p>You can only contact people when you have a strong reason to reach out to them. One of such reasons is that there&#8217;s a legal ground for it &#8212; your business statute is clearly connected to theirs. Some of the regulations I dug out stated that you need consent before you can <span id=\"urn:enhancement-cf3f7ec3\" class=\"textannotation disambiguated wl-thing\">email<\/span> anyone.\u00a0Even though cold <span id=\"urn:enhancement-7cba5648\" class=\"textannotation disambiguated wl-thing\">email<\/span> isn&#8217;t a promotional offer.\u00a0Collecting prospect&#8217;s consent is\u00a0obligatory in Canada, China, and Norway. When it comes to Germany &#8211; you need double consent.<\/p>\n<h4>How to collect consent for email outreach?<\/h4>\n<p>A nice strategy to contact people in those countries may be using inbound + outbound strategy. For example, creating a webinar and then firing an outreach campaign\u00a0once it ends. Of course, you would contact only the people who gave you their consent for being contacted.<\/p>\n<p>We&#8217;ve tried mixing inbound with outbound. Here&#8217;s how we went about it:<\/p>\n<ul>\n<li><a href=\"https:\/\/woodpecker.co\/blog\/prospecting\/targeting-quora\/\" target=\"_blank\" rel=\"noopener noreferrer\">How We Found our Prospects on Quora: Vol. 1\u00a0 &gt;&gt;<\/a><\/li>\n<li><a href=\"https:\/\/woodpecker.co\/blog\/cold-email\/quora-email\/\" target=\"_blank\" rel=\"noopener noreferrer\">How We Asked Quora People to Attend Our Webinar: Vol. 2 &gt;&gt;<\/a><\/li>\n<\/ul>\n<h3>Rule #5: Inform about a message\u00a0type<\/h3>\n<p>Sometimes you&#8217;re expected to inform prospects about the type of your message. You need to be clear about the nature of your message, so you and the recipient are on the same page. That&#8217;s understandable. If your message is for commercial purposes, you&#8217;re required to put that in your <span id=\"urn:enhancement-f39a1be3\" class=\"textannotation disambiguated wl-thing\">email<\/span> copy.<\/p>\n<p>All the\u00a0regulations asked for it except from the US CAN-SPAM Act. Just to be clear you need to inform your\u00a0addressee about the type of your message when you send your <span id=\"urn:enhancement-71e835c\" class=\"textannotation disambiguated wl-thing\">emails<\/span> to companies located in:<\/p>\n<ul>\n<li>China<\/li>\n<li>Canada<\/li>\n<li>Australia<\/li>\n<li>New Zealand<\/li>\n<li>Germany<\/li>\n<li>Switzerland<\/li>\n<li>Norway<\/li>\n<li>&#8230;and the rest of the EU member states<\/li>\n<\/ul>\n<h3>Rule #6: Don&#8217;t\u00a0go for clickbait in your subject line<\/h3>\n<p>Subject lines are like <a href=\"https:\/\/woodpecker.co\/blog\/cold-email\/what-subject-line-will-make-my-addresses-open-my-cold-email\/\" target=\"_blank\" rel=\"noopener noreferrer\">keys\u00a0that open your messages<\/a>. They are the very things\u00a0that catch your prospect attention and make them\u00a0click on\u00a0your <span id=\"urn:enhancement-c670069\" class=\"textannotation disambiguated wl-thing\">email<\/span>. You may feel tempted to put something attention-grabbing in your subject line to make it irresistible to open.<\/p>\n<p>Beware of clickbait, though. It may get you into trouble in the USA and Germany. If you use a subject line that doesn&#8217;t correspond to the rest of your <span id=\"urn:enhancement-c20149cc\" class=\"textannotation disambiguated wl-thing\">email<\/span>, you may get penalized. Same goes for\u00a0the &#8220;From:&#8221; line.<\/p>\n<h2>Where can I learn more about the law?<\/h2>\n<p>Here you have basic findings that I found the most useful. Next time you sit to prepare your cold email campaign,\u00a0make room for the rules above. This may seem like another uninteresting thing to have on your mind, but trust me, it&#8217;s better to be safe\u00a0than sorry.
